Alternative dispute resolution
Besides offering traditional legal services we focus on alternative dispute resolution processes, which:
- Provide a structured but informal setting to move forward from protracted or potential conflict.
- Saves time
- Saves money
- Saves relationships by assisting the parties to assume a new direction
- Gives you control of your own decision making
Mediation
Many people and organisations, when forced to think about going to Court prefer to negotiate their own private arrangements with the assistance of a neutral person, rather than put their decisions in the hands of the courts.
Parties can be assisted and helped to communicate better and to minimise conflict whilst ensuring that future relationships endure.
family DISPUTE RESOLUTION
Changes to the dispute resolution provisions of the Family Law Act 1975 have been phased in since July 2007. The law now requires separating families who have a dispute about parenting arrangements to make a genuine effort to resolve that dispute by family dispute resolution before they can apply to a court. These changes mean that before applying to the court for a parenting order it is first necessary to attend family dispute resolution, and obtain a certificate from a registered family dispute resolution provider confirming an attempt at family dispute resolution was made. Frances Doyle is registered by the Attorney General as such a provider. (registration number R0002379)
In this process we do not give Legal Advice but before attending all parties should obtain separate legal advice to be aware of their legal rights.
collaborative law
Collaborative law offers a fresh approach to resolving the issues that may lead to Court. In a collaborative process, the clients and their lawyers agree to work together to find a fair solution to disputed issues without involving a court. In this process clients and lawyers, enter a formal agreement, to use a collaborative approach to avoid submitting contested issues to the court. The Collaborative process is suited to resolving many types of disputes, especially where there is a need for continuing relationships between the parties. It works well for both Commercial and Family Disputes.
